Requirements for Shariah Decision-Making in the Banking System of Iran Using Delphi Fuzzy Method

Abstract
Shari'ah decision-making (SDM) has become one of the elements of Islamic banking, which seeks to determine and regulate the Shari'ah rulings and decisions related to the operations and activities of Islamic banks. This decision-making and determination of religious rulings leads to ensuring that banking operations comply with the principles and standards of Shariah. The institutions responsible SDM in the banking system, which include internal Sharia supervisory Board, the central Sharia board, and management & the organs of governance other than the Sharia supervisory board, must adhere to certain requirements in order to make correct decisions. 33 research samples were selected using purposeful snowball sampling method. Following literature review, the principles of Imami jurisprudence, upstream Laws and especially the governance standard (GS) 18 of the Accounting and Auditing Organization of Islamic Financial Institutions, four categories of requirements along with 21 components were extracted and identified. In the general classification, attention to general and specific jurisprudential regulations, attention to environmental, social, and governance issues (ESG), attention to sustainable development goals (SDG), and value-based intermediation (VBI) are categorized under positive requirements, while avoiding psychological Tendencies factors is categorized under negative requirements. In the following, 21 identified components were exposed to the experts through a questionnaire, and by utilizing their opinions and using the fuzzy Delphi method, the extracted requirements were re-evaluated, among which 17 requirements were verified by the expert community
